Terms of Service

These Terms govern your use of the Riptide Roof Estimator web application (the "Service"), operated by Riptide AI Consulting LLC ("Riptide"). By using the Service you agree to these Terms.

1. The Service

The Service uses artificial intelligence to suggest a line-item scope for residential roofing work given a roof spec (and optionally a Roof Diagnose damage report). It then renders a customer-facing PDF estimate using a regional pricing catalog Riptide maintains. The output is informational. It is not a substitute for an Xactimate scope reviewed by a licensed roofing professional, nor a binding bid. Final pricing depends on field measurement, material selection, and post-tear-off conditions.

2. No warranty

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. Riptide makes no warranty that the Service will be accurate, uninterrupted, secure, error-free, or that AI-suggested line items will match your local market unit prices, your carrier's scope, or your final invoiced amount. AI line-item generation may miss items, suggest wrong quantities, or use unit prices that drift from current Xactimate. You assume all risk arising from your use of the Service.

3. Limitation of liability

To the maximum extent permitted by law, Riptide and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, claim denials, repair-cost overruns, contract disputes, or business interruption, arising from your use of the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you have paid Riptide in the 12 months preceding the event giving rise to the claim, or USD $50, whichever is greater.

4. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or attempt to extract the underlying AI models, prompts, or pricing catalog.
• Use the Service to generate estimates for properties you have no business relationship with (e.g. mass-spam estimates).
• Misrepresent Service output to third parties (e.g. presenting AI-generated scope to an insurance adjuster as if produced by certified Xactimate software).
• Exceed reasonable usage limits. We may apply rate limits to protect the Service.

5. Pricing accuracy

The Riptide pricing catalog is a hand-maintained 2026 market-rate dataset based on RSMeans, HomeWyse, contractor surveys, and distributor pricelists. It is updated quarterly. It is not a real-time Xactimate feed.Verify final unit prices against your local market and your carrier's approved rates before sending the estimate to a homeowner. You can edit any unit price in the line-item table to override our catalog default before exporting the PDF.

6. Intellectual property

The Service, including its software, design, brand, and pricing catalog, is owned by Riptide and protected by intellectual-property laws. You retain ownership of the customer data you enter (homeowner name, address, claim numbers, etc.). You grant Riptide a non-exclusive, royalty-free license to use that data solely to operate the Service (run it through our AI provider, debug errors, generate the PDF). We will not sell, license, or publish your customer data to third parties.

7. Termination

We may suspend or terminate access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You can cancel your subscription any time from the Stripe Customer Portal (linked from the badge in the app header).

8. Changes to these Terms

We may update these Terms. Material changes will be notified via prominent notice on the Service. Continued use after a change constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Exclusive venue is the state and federal courts located in Harris County, Texas.
